U.S. Department of Labor Releases Updated Employment Posters

HELENA, MT - The U.S. Department of Labor announced the release of two updated labor law posters required for businesses to post. These updates are in addition to the Employee Rights Under the Family and Medical Leave Act (FMLA) poster updated in April 2016.

These posters are available at no charge through the Montana Department of Labor & Industry (DLI) or local Job Service Montana offices. Businesses should be aware of third-party businesses attempting to sell these posters through aggressive marketing tactics.

The following posters and update information are listed below:

  • The Employee Rights Under the Fair Labor Standards Act (FLSA) poster and Employee Polygraph Protection Act (EPPA) poster have been revised.   The US Department of Labor states employers must post the revised version by August 1, 2016.   
  • The Employee Rights Under the Family and Medical Leave Act (FMLA) poster was revised April 2016. A required posting date has not been provided. The US Department of Labor states: “The February 2013 version of the FMLA poster is still good and can be used to fulfill posting requirements.   

Posters also required by Montana state law include: Equal Employment Opportunity is the Law, Job Safety and Health Protection, Proof of Unemployment Insurance coverage (provided by the Department of Labor and Industry, Unemployment Insurance Contributions Bureau) and Proof of Workers’ Compensation coverage, provided by your Workers’ Compensation Insurance carrier.  Employers are not required to post the State Minimum Wage.

The Montana Department of Labor & Industry will release the updated version of the popular 5-in-1 Labor Law poster in December 2016. Until this updated release, businesses can continue to use their current poster.
